GeoTerva is calculation software for qualified professionals. You stay responsible for checking the results and for your designs. Your project data stays in your browser. You can cancel a plan at any time. The sections below give the details; where the law gives you rights that these terms cannot take away, those rights stay.
1. Who we are and what these terms cover
GeoTerva is the website geoterva.com, the GeoTerva web application and its modules, the Theory and Manual pages, the report tools and the GeoTerva mobile apps (together, the Service). The Service is operated by GeoTerva (geoterva.com) (GeoTerva, we, us).
GeoTerva (geoterva.com) is operated by an engineer based in Türkiye. The operator's legal name, address and tax details are published on this page before paid plans open. Contact: info@geoterva.com.
These terms are an agreement between you and GeoTerva. They apply when you visit the Service, try the demos, create an account, start the free trial or buy a plan. By creating an account, ticking the box that says you agree, or using the Service, you accept them. If you use the Service for a company or another organisation, you confirm that you may bind it, and "you" then includes it.
These documents are part of the agreement: the Privacy Policy, the Cookie and local-storage notice, the Cancellation and refund policy, and the description of the plan you choose on the Pricing page. If they conflict, the plan description and the refund policy come first for what you buy, and these terms come first for everything else.
You must be at least 18 years old, or have the legal capacity and your guardian's consent, to create an account or buy a plan.
2. The Service
GeoTerva provides browser-based geotechnical calculation modules. Each module has an input form, drawings, the steps of the calculation, a Theory tab with the method and its sources, and report tools. The modules are grouped into module packs. The Modules page and the plan description say what each plan includes.
Calculations run in your browser, on your device. We do not receive the inputs or the results of your calculations. Your inputs, ground profiles and report details are kept in your browser's storage on your device, as described in the Cookie and local-storage notice.
We may improve, add, change or retire modules and features. If a change takes away something that a paid plan promised in a way that matters, we will tell you in advance, and you may cancel and receive a refund of the unused part of what you paid.
We work to keep the Service available, but we do not promise uninterrupted access. There can be maintenance, outages and problems with the services we rely on. You need a modern browser and a connection; you are responsible for your own device and connection.
3. Accounts
You can create an account with a username and a password, or with Google ("Continue with Google"). Give accurate information, keep your sign-in details secret and tell us at info@geoterva.com if you think someone else has used your account. You are responsible for what happens under your account.
An individual plan is for one person. You may not share your account or sell access to it. Team and Enterprise plans cover the named users in the agreed plan; the person who manages the plan is responsible for those users.
While the Service is in preview, accounts and plan choices are kept in the browser where you created them (see the Privacy Policy). Clearing that browser's data removes them. When accounts are stored on our servers we will tell you before the change.
4. Free demos and the free trial
Some modules can be tried without an account. A free account lets you use all modules for 7 days after you sign up, on screen only: saving, exports and reports are part of the paid plans. No card is needed. When the 7 days end your access to the full modules ends, and nothing is charged. We may change or end the free offers.
5. Plans, prices and payment
Paid plans are being opened. When they are available, this section applies to your purchase.
- Plans. You can buy a single module pack, a discipline bundle or GeoTerva Complete, billed monthly or yearly. Team and Enterprise plans are agreed with us. The Pricing page and the checkout show what each plan includes and costs.
- Prices and taxes. Prices are shown in US dollars unless the page says otherwise. Prices exclude value-added tax, goods-and-services tax and sales tax unless the page says they are included; the tax that applies to you is added at checkout. Where the law requires it (for example for consumers in Türkiye), the price shown includes tax.
- Who sells and who takes the payment. Payments are handled by a payment provider named at checkout. Depending on the provider, it may be the seller of record and issue your invoice; if so, its buyer terms also apply to that purchase. We do not receive or store your full card details.
- Renewal. A plan renews automatically for the same period until you cancel, and the payment method you gave is charged at the start of each period. We send a reminder by e-mail at least 14 days before a yearly renewal. Consumers in Türkiye: yearly plans bought by consumers are not renewed automatically; we ask for your approval before each renewal.
- Price changes. A new price applies from your next renewal, and only after we have told you at least 60 days before it. If you do not accept the new price, cancel before it applies and you will not be charged it. The price of a period you have already paid does not change. A founding-member price stays fixed for as long as your subscription runs without a break, as described when you bought.
- Regional prices. Where we offer a regional price list, it depends on your billing country. Giving a false country to get a lower price breaks these terms.
- Failed payments. If a payment fails we try again and tell you. If it still fails your access may be paused until the payment is made.
- Changing plans. An upgrade takes effect at once and you pay the difference for the rest of the period; a downgrade takes effect at the next renewal.
6. Cancellation, refunds and withdrawal
You can cancel a plan at any time in your account or by writing to info@geoterva.com. After you cancel, nothing more is charged. The details, including refunds, are in the Cancellation and refund policy; in short:
- You keep access until the end of the period you have paid for.
- A yearly plan has a 30-day money-back guarantee from the first purchase (and 14 days from an automatic renewal). Ask us and we refund the plan price you paid.
- If you are a consumer, the rights that the law of your country gives you are not reduced by anything here. For consumers in Türkiye, the Distance Sales Agreement and the Preliminary Information Form apply as well.
- If you buy a plan and start using it at once, you ask us to start the service immediately. The law of some countries (including those of the European Union and the United Kingdom, and Türkiye for services whose performance began with your approval) then limits the right to withdraw from a distance contract once the service has started. Our money-back guarantee applies to yearly plans whatever the law says.
7. Licence and acceptable use
While you have access, we give you a personal (for Team and Enterprise plans: organisational), non-exclusive, non-transferable and revocable licence to use the Service and to produce reports with it for your professional, business, academic or personal work. You may use the results and the reports in your projects and give them to your clients and to the authorities.
You may not:
- copy, sell, rent, sublicense or share the Service or your access to it;
- take the Theory, Manual, drawings or other content out of the Service in bulk, or use robots, scrapers or other automatic means to do so;
- get round the sign-in, the plan limits or the free-trial limits;
- decompile, reverse engineer or try to get the source of the Service, except to the extent that the law allows that despite this clause (for users of computer programs in Türkiye, Article 38 of Law No. 5846 and, in the European Union, Directive 2009/24/EC);
- use the Service to build or train a competing product or service;
- interfere with the security or the performance of the Service, try to reach what is not yours, or send malicious code;
- use the Service in breach of the law or of other people's rights.
The Service contains open-source components, such as the fonts we serve (SIL Open Font License). Their licences apply to them, and nothing here limits your rights under those licences.
8. Your data and your content
Your inputs, project data, report details and files are yours. We claim no ownership of them. Because the calculations run in your browser, we do not normally have them. If you send us something, for example with a support request, we use it only to help you.
Your work is kept in your browser's storage and in the files you save or export. You are responsible for saving and backing up what matters to you: browser storage can be cleared.
If you give us ideas or feedback about the Service, we may use them without owing you anything for them.
9. Intellectual property
The Service, including its software, design, texts, drawings, Theory and Manual pages, names and logos, belongs to us or our licensors and is protected by law. Except for the licence in section 7, you receive no rights in it. The standards and the literature we cite are named for identification; they remain the property of their owners.
10. Engineering responsibility
GeoTerva is a set of calculation tools for qualified engineers and technical professionals. It helps you set up a problem, run a recognised method, see the working and prepare a report. It is not an engineering service, it does not act as the engineer of record, and it does not replace professional judgement, site investigation, laboratory testing, the codes and standards that apply, or independent checking.
- The method and the inputs decide the result. The Theory tab of each module states the method, its sources, its assumptions and its limits. Before you rely on a result, check that the method suits your problem, that every input and unit is right, and that the result is reasonable, for example by a hand check or an independent calculation.
- You remain responsible for the design decisions you make with the results, for compliance with the codes, standards and regulations that apply to your project and place, and for any certification or sealing that your profession requires. Your professional responsibility does not pass to GeoTerva.
- Results can contain errors. We document our methods and test the modules, but no software is free of errors, and methods and code change over time. If a result looks wrong, tell us at info@geoterva.com and we will look into it.
- Decisions where a failure could endanger people or property must not rest on a result from GeoTerva alone. They need review by a qualified professional who is responsible for them.
11. No other warranties
To the extent the law allows, the Service is provided "as is" and "as available". We do not promise that it is free of errors, that it is uninterrupted, or that a result is accurate or fit for a particular design or purpose, and we exclude the warranties implied by law as far as the law lets us. If you are a consumer, the rights that the law gives you for a service that does not match what we described remain.
12. Our liability
- To the extent the law allows, we are not liable for indirect or consequential loss, lost profit, lost revenue, lost data, loss of business or goodwill, project delay, the cost of rework, or damage to structures or property that arises from using the Service or relying on a result.
- Our total liability to you for all claims related to the Service is limited to what you paid for the Service in the 12 months before the event that caused the claim (or to US$100 if you paid nothing).
- Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, for intent or gross negligence (Turkish Code of Obligations, Article 115), or any right that the law gives you as a consumer. For consumers, the limits in this section apply only as far as mandatory consumer law allows.
13. Your responsibility to us (business customers)
If you use the Service for a business, you will compensate us for claims brought by a third party and for the costs they cause us, to the extent they arise from your breach of these terms or from your use of the Service in breach of the law or of someone's rights. This section does not apply to consumers.
14. Ending the agreement
You can stop using the Service and cancel at any time. We may suspend or end your access if you do not pay, if you seriously or repeatedly break these terms, if you put the Service or other users at risk, or if the law requires it. Where we can, we tell you first and give you the chance to put it right. If we end your access for a reason other than your breach, we refund the unused part of what you paid.
If we stop offering the Service altogether, we give you at least 60 days' notice and refund the unused part of what you paid. When the agreement ends your licence ends. The sections that by their nature should continue (for example intellectual property, disclaimers, liability and governing law) continue.
15. Changes to these terms
We may update these terms, for example when the Service or the law changes. We publish the new version on this page with its date. For a change that matters to paying customers we tell you by e-mail or in the Service at least 30 days before it applies. A change does not reduce what you have already paid for during your current period. If you do not accept the change, cancel before it applies and we refund the unused part of what you paid.
16. Privacy
How we handle personal data is described in the Privacy Policy and the Cookie and local-storage notice.
17. Other services and links
Some features use services of others: signing in with Google (Google's terms and privacy policy apply to that sign-in), the payment provider, and the providers that host and protect the Service. We do not control them or the websites we link to.
18. Sanctions and export rules
You confirm that you are not on a sanctions list and are not located in a territory under comprehensive sanctions, and that you will not use the Service in breach of the export-control or sanctions rules that apply. We may refuse or end access where the law, or our payment provider, requires it.
19. Governing law and disputes
Please write to info@geoterva.com first; most problems can be settled that way. If not:
- Business customers: the law of the Republic of Türkiye applies, and the courts and enforcement offices of the operator's place of business have jurisdiction.
- Consumers: the law of the Republic of Türkiye applies, but you keep the mandatory consumer protection of the country where you normally live and the right to bring a claim in the courts of that country. A consumer in Türkiye may apply to the consumer arbitration committee or the consumer court of the place where they live, within the limits the law sets.
20. General
These terms, with the documents named in section 1, are the whole agreement between you and us about the Service. If a part is found invalid, the rest stays in force. If we do not enforce a right at once, we have not given it up. You may not transfer the agreement without our consent; we may transfer it to a successor of the business. Neither of us is liable for a delay caused by events beyond reasonable control.
These terms are published in English and in Turkish. For consumers in Türkiye the Turkish text applies; for everyone else the English text applies.
